The pandemic caused many employers to rethink which of their employees needed to be at the worksite and who can work from remote locations. Now, many of those who worked remotely during the height of the pandemic want to continue doing so, causing complications for risk prevention. As a guest on The JoyPowered® Workspace Podcast, Senior Employment Counsel & Chair Corinne Spencer shared ways to minimize legal risks when creating a hybrid workplace.

“I think examining your workforce and the job requirements of each position is important so that you have a system in place to decide who does get flexibility and who does not,” Spencer explained. “That way you can avoid any kind of appearance of favoritism.” Spencer also advised employers to set expectations of what hybrid or flexible work looks like in a written agreement so there is no misunderstanding.
